It would be recalled that at the fourth meeting of the Lusaka MULPOC council of ministers ad second extraordinary meeting of ministers of trade, finance and planning it was decided that provisions should be made concerning the composition, competence, statute and other matters relating to the tribunal of the PTA. The attached draft general provisions seek to do this by way of general provisions to be prescribed by the Authority in pursuance of paragraph 2 of Article 11 of the draft PTA treaty, at its first meeting which could be upon the signing of the PTA treaty by or on behalf of the requisite number of the high contracting parties.
The devise which is in accordance with the provisions of the draft PTA treaty is preferred to a protocol which is not provided for under the draft PTA treaty.
