Dakar Financing Summit High-Level Panel 2 Session 3: Enabling Policy Environment to Enhance Infrastructure Investment and Bankability Script for the ES. The ES will provide a brief introduction to the Session, There are compelling reasons to critically examine the applicable legal and regulatory regimes in Africa against the backdrop of the objective of regionally integrated infrastructure development: Divergent legal systems have varied implications on infrastructure finance and development, particularly when regional or collaborative projects are contemplated or undertaken. Investors require a reasonably clear, accessible and transparent legal framework within which to invest and implement projects, which guarantee outcomes and engender investor confidence; at the regional level, policies have to be coordinated and harmonized. The policy and regulatory frameworks on the continent needs to be stable and consistent, to facilitate the implementation of regional projects. The general perception of lack of transparency in the procurement and tendering process of infrastructure projects in Africa, may act as a disincentive to foreign investors.
